These Terms of Sale (“Terms of Sale”) apply to all purchases of products made from Hivara (“we,” “us,” “our”) through our website at hivara-uk.myshopify.com (the “Site”).

By placing an order on our Site, you agree to be bound by these Terms of Sale, our Terms of Service, and our Return & Refund Policy.

1) Formation of Contract

When you place an order, you are making an offer to purchase products subject to these Terms of Sale.
A binding contract is formed only when we accept your order by sending an order confirmation or dispatch confirmation email.

We reserve the right to refuse or cancel any order in accordance with our Terms of Service.

2) Product Availability

All products are subject to availability.
If a product becomes unavailable after you place an order, we will notify you and issue a full refund for the unavailable item.

3) Prices

All prices are displayed in GBP or USD unless stated otherwise and include applicable taxes where required by law.

Shipping costs, customs duties, and import taxes (if applicable) are not included in the product price and will be shown at checkout or charged by local authorities upon delivery.

We reserve the right to change prices at any time, but price changes will not affect orders already accepted.

4) Payment

Payment must be made in full at the time of purchase using the payment methods available at checkout.

By completing a purchase, you confirm that:

  • You are authorized to use the selected payment method

  • The payment information provided is accurate and complete

5) Delivery

Delivery is governed by our Shipping Policy.
Estimated delivery times are not guaranteed and delays do not automatically entitle you to cancellation or compensation, except where required by applicable law.

Risk of loss passes to you upon delivery of the goods, unless otherwise required by law.

6) Right of Withdrawal & Returns

Your right to withdraw from a purchase and return items is governed by our Return & Refund Policy.

EU/EEA and UK customers benefit from statutory consumer rights, including the 14-day right of withdrawal, subject to legal exceptions.

Nothing in these Terms of Sale limits or excludes mandatory consumer rights under applicable law.

7) Faulty or Non-Conforming Goods

If a product is faulty or does not conform to the contract, you are entitled to remedies under applicable consumer protection laws, including repair, replacement, or refund.

These rights exist independently of our voluntary return policy.

8) Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising out of or in connection with a purchase is limited to the price paid for the product.

This does not apply where liability cannot be limited or excluded under applicable law, including for death, personal injury, or statutory consumer rights.

These Terms of Sale are governed by applicable consumer protection laws based on your country of residence.
Where permitted, any disputes shall be subject to the laws applicable to our business operations.
